These Terms of Use govern the obligations and duties of the website en.hetflirt.com (hereinafter - "the Site"), between the owner of the Site (hereinafter "the Owner") and the user of the Service (hereinafter "the User"). Please read these Terms of Use carefully before visiting the Site and/or using the services of the Site. This website is owned and operated by Logic Marketing SLTD, Bulgaria, Sofia, Blvd. Positano 9a, office 5, 1000.

Should there be any points in these terms of use that you "the user" cannot accept, or if you have any difficulty in understanding the meaning of these terms, you should immediately discontinue your visit to the website.

By this or any future visit to the website and/or use of the website, you accept these terms of use without reservation. These terms and conditions take precedence over any other terms and agreements between the owner of en.hetflirt.com.se and the user.

To use en.hetflirt.com and its features, the user needs to register and create a personal password.

Definitions:

By accessing, connecting, using the website the user accepts this agreement and user confirms when using the service that:

1.1  The User is at least 18 years of age.

1.2 The User has read the terms and conditions of this Agreement.

1.3 The User is solely responsible for the content and material that he/she publishes on the Website, and that the User has the necessary authorization and data security for this.

1.4 Acknowledges that the User is aware that the Website may contain material that is only intended for users who have reached at least 18 years of age.

1.5 Use the Website in accordance with the applicable legislation in the relevant area of law.

1.6 Not to publish e-mail addresses, telephone numbers, hyperlinks or other contact information that has open access in the user account.

1.7 Not to post profanity, racial slurs, defamation of any person(s), child pornography or other immoral material, including in material that depicts or promotes violence, cruelty, terror, or material offensive to human dignity, or other material not permitted by applicable law.

1.8 Not to persuade, mislead, harass, or interfere with other users, when there is a clear indication from the other user of an aversion to the occurrence of any of the above. Under no circumstances may Users use the Service for the purpose of pimping, brokering, prostitution, exploitation, or fence-stealing.

1.9 Not, without the owner's consent make transactions or offer contracts with other users in relation to any works or services, as well as goods, or use the site for the dissemination of advertising material, illegal material, or propaganda.

1.10 Not to transmit viruses or other computer instructions, technical means that damage or interfere with the use of en.hetflirt.com as well as its systems and not to use any robot, or other automated means to access the en.hetflirt.com website or services for any purpose without owners written permission.

1.11 Not attempt to gain unauthorized access to the Services, user accounts, computer systems or networks connected to the Services through hacking, brute force or any other method.

1.12 Not attempt to circumvent technical implementations carried out/implemented by the owner.

1.13 Not to otherwise violate or circumvent these Terms.

1.14 Permit en.hetflirt.com to distribute, reproduce, translate, and adapt as well as report material posted on the website or submitted to en.hetflirt.com by any other means, wire, cable or digital, with exclusive rights.

1.15 Should any term or provision of this Agreement be declared invalid, unfair or lack the force of law by a court of competent jurisdiction (clause 6.6), the remaining terms and conditions shall remain valid, and the invalid, unfair term or provision shall be converted into a valid term or provision reflecting the original intent of the Owner.

Contents of the Website

2.1 en.hetflirt.com aims to enable different users to communicate with each other on the "en.hetflirt.com" website. The main purpose of the platform is to bring different users in contact with other users so that they can communicate digitally with each other on the site.

2.2 The main purpose of the service is not to create real contact outside the site between a user and other users of the site. However, it is allowed for the User to establish real contact with other Users outside the Site. However, the Owner can in no way guarantee or warrant that such real contact can be established via the Website.

2.3 en.hetflirt.com reserves the right to create profiles on the Website and to send messages to the User through these accounts. By accepting these Terms of Use, the User understands and accepts that some of the profiles on the Site are therefore fictitious and have been created for entertainment purposes only. It is therefore not possible to meet these profiles in real life outside the Site or to communicate with these profiles outside the Site.

2.3.1 en.hetflirt.com may use the fictitious profiles for marketing purposes, to improve the functionality of the service and for entertainment purposes. The fictitious profiles do not exist in real life and communication with these fictitious profiles is not possible outside the website.

2.4 The User is not entitled to create accounts for others, transfer an account or allow other persons to use his/her account. If for any reason the information about the User is no longer accurate or complete, the User must change the information to bring it back up to date. If the user provides inaccurate or incomplete personal information and the owner decides that the information provided is not accurate or incomplete, the owner may terminate or block the user's account.

2.5. The User is fully responsible for keeping his/her password secure. The user is also fully responsible for the use of the account by third parties, regardless of how the account was accessed. In case of suspected misuse of the account, the user shall immediately inform en.hetflirt.com

2.6 The Owner uses third party websites to send visitors to the Website, either for a fee or free of charge. These third parties arrange so-called hyperlinks and are themselves responsible for the content of the website and for the way they forward users to en.hetflirt.com, through hyperlinks.

2.7 When creating an account on the website, the user guarantees that the information provided is correct and truthful. The user is obliged to immediately inform the owner if the information provided during registration has changed and to update his/her user data himself/herself.

2.8 The Owner operates a central membership database which is used on several websites. The User's profile will therefore be available on other websites belonging to the Owner. The User can therefore log in to any of these partners' websites without having to create an account.

3.3 Make changes to this Agreement unilaterally at any time. It is the User's responsibility to review these Terms and Conditions from time to time. If the User continues to use the Website after the effective date of changes to the Terms of Agreement, the User accepts these changes without reservation.

3.4 Change the type and price of the Services and the time when this shall occur.

3.5 Remove or edit content posted by the User on the Website if it does not comply with the terms of this Agreement or is considered harmful to both the Owner and third parties.

3.6 Use the User's personal data published by the User on the Website to use these data for commercial purposes, post on partner websites and for other purposes.

3.7 Transfer the rights of a User under this Agreement to a third party for the purpose of implementing this Agreement without the User's consent.

3.8 en.hetflirt.com reserves the right to refuse use of its services, suspend accounts or restrict access to the services at its sole discretion where it is believed to be harmful to the owner or third parties, or due to a breach of these terms. Such suspension or restriction of access may be implemented by en.hetflirt.com immediately and without any prior notice, notification, or refund. en.hetflirt.com may suspend the User's account and in some cases request clarification, investigate or request that the User clarify their actions and provide additional information. If the user's account has been suspended, the user must contact us for more information. en.hetflirt.com may suspend the user's account for a reasonable period before permanently terminating a user's account.

3.9 Delete user accounts that have been inactive for more than six (6) months, any outstanding credits and content on the user account will be deleted and will not be available again. To become a member again, the user must create a new user account. The term inactive means that the user has not logged into his/her user account during the specified period of six (6) months.

Liability:

4.1 en.hetflirt.com will make every effort to prevent the Service from experiencing technical disruptions while the User is using the Service. However, en.hetflirt.com cannot be held liable for technical interruptions, complications, actions, changes to the platform, usability, force majeure events or other causes that affect access to the service.

4.2 en.hetflirt.com takes laws and regulations very seriously, therefore en.hetflirt.com has developed a procedure whereby all images and texts uploaded to a user's profile are manually reviewed before being published on the site. en.hetflirt.com does this to discourage and protect our users from uploading illegal material. If, despite this, there is material, or other activity, that is questionable, please see section 11, Reporting Illegal Content, for how to submit such a request.

4.2 Content that, in your opinion as an operator, infringes your copyright, or if someone has otherwise infringed your copyright, you are requested to contact en.hetflirt.com directly by sending an email to support@en.hetflirt.com

4.3 en.hetflirt.com assumes no responsibility for the harmful use of data provided by the user to third parties. Nor is en.hetflirt.com liable for unauthorised access by third parties to the users' personal data (for example, through unauthorised access to the central database), unless en.hetflirt.com has made such unauthorised access by third parties possible intentionally or through gross negligence.

4.3.1 en.hetflirt.com is not responsible for the accuracy or inappropriateness of the content of a profile, where the content reflects the views of another user. Thus, under no procedure whatsoever does en.hetflirt.com hold responsibility for direct or indirect damages arising from the use of the service. Consequently, en.hetflirt.com hereby waives its liability as en.hetflirt.com holds, to the extent legally supported.

4.4 en.hetflirt.com is only liable (except for breach of material contractual obligations), for injury to life, body or health or for claims under Bulgarian or EU law - for wilful misconduct and gross negligence. The term "essential contractual obligations" refers to those obligations whose fulfilment is mandatory for the achievement of the purpose of the contract.

4.5 In the event of a minor negligent breach of an obligation which is essential to the achievement of the purpose of the contract, the liability of en.hetflirt.com shall be limited to the loss which can be calculated and which is typical for similar relevant activities in the area.

4.6 The above limitation of liability also applies to the personal liability of employees, representatives and agents of en.hetflirt.com

Payment

Credits are a virtual currency required on the site to chat, flirt, and access all of the site's features. All prices shown always include VAT and other government taxes.

5.1 The user must fill in so-called "Credits" to be able to chat, flirt, and access all the features of the website. These "Credits" are available for purchase in different packages, the price of which varies and is available on the payment page. The user purchases these "Credits" by making payment in local currency.

5.1.2 In order for the User to purchase "Credits", the User will be redirected to an external payment provider to complete the purchase.

5.2 A user is entitled to a full refund within 14 days of the purchase taking place, unless the user chooses to use any of the products purchased by the user. If this is the case, the right to a refund is lost. It is up to the user to inform en.hetflirt.com that the purchase will be returned to the user.

5.2.1 In the event of a payment dispute between the user and en.hetflirt.com, the information provided by the owner is decisive in determining the actual amount, unless the user can prove that the information referred to by the owner is incorrect.

5.3 If the User deletes his/her account, the User also deletes any outstanding credits. The user cannot then claim any outstanding credit if the account has been deleted.

5.4 If a User requests a so-called "chargeback" to be carried out without a valid reason, the Owner reserves the right to charge the User with the additional costs incurred.

Disputes and complaints:

6.1 Given that the owner of the website is not involved in the communication between the users of the website, the owner disclaims any kind of liability or damages, both direct and indirect, in accordance with this agreement.

6.2 In the event of a complaint by the user of the website during the use of the website, the owner of the website will take this as seriously as possible.

6.3 Complaints can and shall only be returned in writing by the user to the owner of the website.

6.4 It is the responsibility of the owner of the website to try to find a solution to the complaint as soon as possible.

6.5 If the user and the owner cannot find a solution to the problem, the user may use the European Commission's online dispute resolution portal https://ec.europa.eu/consumers/odr/main/?event=main.home2.show

6.6 These Terms of Use and any use of the Website and its services are subject to and governed by the laws of the country of Bulgaria. Any claim may only be brought before a Bulgarian court. Users agree that only the general court of the jurisdiction of Bulgaria will have exclusive jurisdiction to decide/decide/over any dispute arising out of or in any way relating to these Terms or the Services.

Cancellation policy

7.1 You have a right to cancel your membership at any time. You can cancel your membership from your user account. Canceled accounts will not be reimbursed for the unused part of the current service. 

7.2 In the event of cancellation of the agreement between the parties for whatever reason, the user's right to use the service is terminated with immediate effect and access to the service is denied. Upon termination, the owner will delete the account and content published by the user, except for the content that the law or regulation may require the owner to save in order to fulfil its obligations. The owner is not obligated to provide the user with any materials after the expiration of the agreement.

Licence, authorization and permits

8.1 The User assures that the content posted or created by the User and its use, does not infringe upon the interests of third parties, in particular copyright or other legal rights.

Class action clause

9.1 To the extent permitted by the applicable jurisdiction of this Agreement (Section 6.6), class actions, class wide arbitrations, private attorney actions, and any other proceedings in which someone acts as a representative of a person are not permitted. Unless both the User and en.hetflirt.com agree, no arbitrator or judge may consolidate more than one person's claims or otherwise preside over any form of representative or class proceeding

Intellectual Property

10.1 All information available on the Site is the intellectual property of the owner of en.hetflirt.com or its licensors and thus may not be reproduced under any circumstances for private or commercial purposes.

10.2 Should the owner of the website be informed that a certain type of material on the website such as images, texts or links may be offensive in nature, the owner reserves the right to remove such content as soon as possible. However, there is no obligation on the owner to do so unless the material is of such a nature that there is no doubt as to its offensive nature.

Reporting illegal content

Breach of these conditions

12.1 If it appears that a breach of these terms and conditions is taking place, or other acts that are indifferent to the fact that a breach has been committed/is fraudulent in nature, the owner of the website reserves the right, without consent or regret, to block the membership of the user at the same time. Any outstanding "Credits" will thus be deemed to be used up and irretrievable.

Miscellaneous

13.1 Users may not transfer/assign these Terms or any rights or interests under these Terms or delegate any obligations to be performed under these Terms without en.hetflirt.comS prior written consent. en.hetflirt.com may assign its rights and obligations under these Terms to selected third parties without your consent, including but not limited to, in the event of a corporate reorganization, merger, acquisition, sale or transfer of all or substantially all its assets.
